Whoever leaves their accommodation early remains in principle liable for rent until the next termination deadline. According to art. 264 CO, this obligation ends earlier if you quote the lessor a reasonable and solvent replacement tenant, ready to take over the accommodation on the desired date under the same conditions. One suitable candidate is enough; however, several complete files reduce the risk of a last minute withdrawal.
Early departure to Switzerland: what is provided for in art. 264 CO ?

The legal basis for early departure without respecting the deadlines or ordinary termination dates is art. 264 of the Swiss Code of Obligations (CO). The law provides that the tenant is released from his contractual obligations if he quotes the lessor a reasonable and solvent replacement tenant.
A very widespread misconception is the so-called “myth of the three successor tenants”. Many tenants still think they must submit three files. The law is however clear: it is enough to propose a single suitable candidate, ready to take over the lease under exactly the same conditions. However, anyone who does not rely on a single candidate runs a high risk. If the latter withdraws at the last moment before signing the contract, the former tenant remains responsible for the rent. It is therefore recommended in practice to always submit several files to be covered.
The reasonableness of a successor tenant is based on objective criteria. The successor must be acceptable to the lessor – i.e. not entail any essential disadvantages. Over-occupancy of the accommodation or a planned change of use (e.g. use for commercial purposes) are legitimate reasons for acceptance. Financial solvency must also be ensured. In practice, many authorities apply a rule of thumb that the gross rent should not exceed approximately one third of the net income. This is not a rigid legal limit in art. 264 CO. A current extract from the prosecution register is often required. The question of whether certain registrations exclude solvency must be assessed according to their nature, amount and explanation.
Procedure and deadlines when searching for a successor tenant: successful transition without stress

The procedure begins with the written announcement of the anticipated return of the accommodation. For reasons of proof, send this letter in writing, ideally by registered mail or by another means with acknowledgment of receipt, to the management company or the lessor. It is important that all the main tenants registered in the lease – for example in the case of a couple or shared accommodation – sign the document. Clearly indicate the date you wish to return the accommodation early and keep a copy with proof of delivery. To prepare yourself, preferably use structured moving checklists so as not to miss any administrative steps. To keep the financial aspects of your change of accommodation under control, you can first calculate the expected moving costs.
Once you have found potential successor tenants, they must complete an application form. The Swiss Tenants Association (ASLOCA) provides standardized models for this purpose. On this form, the candidate must confirm in writing that he is ready to take over the accommodation on the desired date under the existing conditions. After submitting the documents, the review period for the lessor begins. Professional authorities in cities such as Zurich, Bern or Basel generally have a reasonable review period of 10 to 20 days. Non-professional private landlords can, according to usual case law, take up to 30 days.
A decisive aspect is the equality of conditions. The lessor cannot use the change of tenant to impose a rent increase on the successor candidate while keeping you responsible. If the agency requires other conditions from the proposed successor, it is worth checking whether your valid replacement quote releases you from the payment of rent from the planned takeover date. Document the initial and new conditions, and seek specialist advice in the event of a dispute.
Practical advice from the editor: Take advantage of the time spent searching for a successor tenant to plan the work related to the handover of the accommodation. As the accommodation must be returned in a clean condition, it is often worth requesting quotes for professional move-out cleaning early on. If you do not wish to carry out the cleaning yourself, professional move-out cleaning with handover guarantee is recommended to avoid unpleasant surprises upon handover. A clean handover prevents discussions on the rental deposit and the defects protocol and ensures a harmonious conclusion.
If the management refuses a solvent and reasonable successor tenant without objective reason – for example because a renovation is planned or a personal need is announced – you are released from the obligation to pay the rent from from the day the successor moved in. You no longer have to pay the rent from this moment, even if the accommodation subsequently remains vacant.
Even without a suitable replacement tenant, the lessor must according to art. 264 para. 3 CO take into account what it saves due to early restitution or gains through other use.

Particularities in the event of a housing shortage and digitalization
In large Swiss cities such as Zurich, Geneva or Basel, the housing shortage is persistent. This generally makes the search for potential successors much easier, as many applications often arrive in a very short time. The challenge here shifts to pre-selection. As property management companies increasingly rely on fully digital application processes, you should inform your applicants to keep all documents (such as the digital extract from the debt collection register and salary slips) directly in the requested format. Complete and readable documents can reduce requests for additional information; they do not guarantee either a specific examination period or the legal release of the lease.
