General conditions (CG) for partner companies

These general conditions (CG) govern the contractual relations between Online-Offerten.ch (hereinafter “the platform”) and the registered partner companies (hereinafter “partners”) for the connection of customer requests (leads) in the fields of moving, cleaning, painting and clearance in Switzerland.

The platform operates an online networking platform on which private and professional clients (hereinafter “clients”) can submit requests for services.

The platform transmits requests to registered partners. There is no right to a specific number or quality of requests.

The conclusion of a contract between partner and client is not guaranteed. The platform is at no time a party to the contract.

3.1 Registration
Registration as a partner requires the sincere and complete indication of all the requested information.

3.2 Obligations of the partner
• The partner undertakes to keep up to date all information relating to the services, areas of activity and contact details.
• The partner guarantees that it has all the authorizations, insurance (e.g. operating liability insurance) and qualifications necessary for the execution of the services offered.
• The partners undertake to handle customer requests with care and professionalism.
• Customer data must be treated confidentially and used exclusively to establish a quote.
• Any transmission of data to third parties is prohibited.
• In the event of violation of these obligations, the platform reserves the right to block the partner or terminate the partnership with immediate effect.

• The transmission of a request does not constitute a binding quote.
• The partner decides autonomously whether to submit a quote.
• The partners are required to process requests within a reasonable time and to contact the customer quickly.
• Pricing, contractual conditions and execution of the service are exclusively the responsibility of the partner.
• The platform does not guarantee the conclusion of mandates nor the economic success of the requests transmitted.
• Customer data can only be used for a single contact and the establishment of a quote.

• Registration on the platform is free.
• The acquisition of requests (leads) may generate costs. The amount is displayed transparently before the purchase.
• By acquiring a lead, the partner accepts the corresponding fees.
• If a contract is concluded between partner and customer, no commission or additional costs are due to the platform.
• Payment terms are made by credits, invoice or electronic means of payment according to the settings of the partner account.

In principle, there is no right to reimbursement.

In justified individual cases (e.g. obviously false or unreachable contact details), the platform may, at its discretion, grant a credit.

• The platform is not responsible for the accuracy or completeness of customer data.
• Any liability for damage arising from contractual relationships between partner and client is excluded, except in cases of fraud or serious negligence.
• Any liability for indirect, consequential damage or loss of profit is excluded.

• The processing of personal data complies with the platform's data protection declaration; this is an integral part of these T&Cs.
• The partners undertake to respect the provisions of the Swiss data protection law (FADP).
• Customer data cannot be resold or used for other purposes.
• After closing the request or in the absence of a quote, the data must be deleted within a reasonable period of time.

• The partnership is concluded for an indefinite period.
• Termination is possible at any time by e-mail.
• In the event of violation of these T&Cs or abusive use, the platform reserves the right to block the partner at any time or to terminate with immediate effect.

• Swiss law applies exclusively.
• The forum is Zurich, Switzerland.
• If certain provisions of these T&Cs are invalid, the validity of the other provisions is not affected.

• Modifications to these T&Cs are communicated to the partners and are considered accepted if no written opposition is filed within 14 days.
• These T&Cs also apply to future services of the platform.
